These terms explain the basis on which you may use the Driving Theory Test Kit app, the drivingtheorykit.app website and related services.

Please read them before using the app.

1. About Driving Theory Test Kit

Driving Theory Test Kit 2026 is a study and revision app designed to help people prepare for the UK car driving theory test.

The app includes features such as theory learning and practice, mock tests, hazard perception learning and practice, lessons, Highway Code material, road signs, progress tracking, personalised study planning and Test Readiness.

Driving Theory Test Kit is an independent product.

It is not affiliated with, endorsed by or approved by the Driver and Vehicle Standards Agency (DVSA).

Where official or licensed third-party learning material is included in the app, ownership of that material remains with the relevant rights holder.

2. Who can use the app

Driving Theory Test Kit is intended for people preparing for the UK car driving theory test.

You may use the app only for your own personal, non-commercial study and revision.

If you are under 18, you should make sure that you understand these terms and, where appropriate, discuss purchases with a parent or guardian.

3. Purchasing the app

Driving Theory Test Kit is intended to be available for a one-off purchase of £3.99.

There is no recurring subscription and no recurring charge for the app unless we clearly introduce and you separately choose to purchase another product or service in the future.

Purchases made through the Apple App Store or Google Play are also subject to the relevant store's terms and payment arrangements.

The relevant app store normally handles the payment transaction and we do not receive your full payment-card details.

Any taxes that must be charged will be handled as part of the applicable purchase process.

4. Consumer rights and refunds

Nothing in these terms affects the rights you have under applicable consumer law.

If you are a UK consumer, digital content you purchase is subject to legal requirements, including requirements relating to satisfactory quality, fitness for purpose where applicable and matching its description.

Where you purchase the app through Apple or Google, refund requests may need to be made through the relevant app store in accordance with its processes and applicable law.

Nothing in these terms limits any refund, repair, replacement, price reduction or other remedy that you are legally entitled to.

5. Your licence to use the app

When you lawfully obtain Driving Theory Test Kit, you are granted a limited, personal, non-exclusive and non-transferable right to use the app for your own study and revision, subject to these terms and any applicable app-store rules.

This does not transfer ownership of the app, its software or its content to you.

You may not, except where the law expressly permits you to:

• copy or redistribute substantial parts of the app or its content
• sell, rent, sublicense or commercially exploit the app or its content
• share licensed learning material outside the app
• systematically extract questions, answers, explanations, lessons, hazard material or other content
• scrape or automatically collect content or data from the app
• attempt to bypass technical measures used to protect the app or its content
• attempt to obtain unauthorised access to our systems or another user's account
• reverse engineer, decompile or modify the app except to the extent expressly permitted by law
• use the app or its content to create or populate a competing question bank, revision product, dataset or service
• use automated systems to make excessive requests or otherwise interfere with the normal operation of the service

6. Your account

Some features may require an account.

You are responsible for keeping your account credentials secure and for activity carried out through your account where that activity results from your actions.

You should not knowingly allow another person to use your account in a way that breaches these terms.

Please contact help@drivingtheorykit.app if you believe somebody has gained unauthorised access to your account.

You are responsible for ensuring that information you provide to us is reasonably accurate and up to date where this is necessary for the operation of your account.

7. Study content

Driving Theory Test Kit provides learning, practice and revision material intended to help you prepare for the theory test.

We take reasonable care over the content and operation of the app, but you remain responsible for your own preparation and for checking any official requirements that apply when you take your test.

The format, rules, pass marks and requirements of the official theory test may change.

We may therefore update the app and its learning material to reflect changes, improve accuracy or improve the learning experience.

8. Test Readiness

Test Readiness is designed to give you a useful picture of your preparation based on evidence generated through your use of the app.

This may include factors such as your:

• learning activity
• topic coverage
• question performance
• mistakes and recovery
• retention
• mock test performance
• hazard perception activity
• study over time

Test Readiness is a study aid, not a prediction or guarantee.

A high readiness level does not guarantee that you will pass your theory test.

Similarly, a lower readiness level does not mean that you will necessarily fail.

Your performance in the official test will depend on many factors outside the app.

9. Today's Plan and personalised study

Features such as Today's Plan and Smart Practice may use your learning activity to suggest what would be useful to study next.

These recommendations are intended to help organise your revision.

You remain free to choose what and when you study.

Study times shown within the app are estimates or planned activity durations and should not be interpreted as a guarantee that a particular amount of study will result in a particular test outcome.

10. Mock theory tests

Mock tests are designed to help you practise theory-test knowledge and become familiar with test-style conditions.

Where we describe a mock as using particular numbers of questions, timings or pass marks, these are based on the test structure the app is designed to simulate at that time.

A pass in a mock test does not guarantee a pass in the official theory test.

11. Hazard perception

Hazard perception learning and practice are designed to help you develop your ability to identify developing hazards.

Practice scores and mock hazard-perception results are study aids and do not guarantee a particular result in the official test.

An internet connection may be required to access hazard perception video content.

12. DVSA and official material

Driving Theory Test Kit is independently developed and operated.

It is not an official DVSA application and is not affiliated with, endorsed by or approved by the DVSA.

Where DVSA or other third-party material is included under licence, that material remains the intellectual property of its respective owner and is made available subject to the applicable licence.

You may not extract, reproduce, redistribute, publish or commercially exploit licensed material except where expressly permitted by law or by the relevant rights holder.

13. Highway Code

Where the app provides access to or learning based on the Highway Code, it is intended as a convenient study resource.

You should refer to current official information where necessary, particularly where rules or legal requirements may have changed.

Nothing in Driving Theory Test Kit constitutes legal advice.

14. Internet connection and offline use

Some parts of Driving Theory Test Kit may be available offline.

Other functionality requires an internet connection.

In particular, features such as online account synchronisation, certain mock-test functionality, hazard perception video and other remotely delivered content may require connectivity.

Your internet or mobile provider may charge you for data usage.

We are not responsible for the availability or quality of your internet connection.

15. Updates

We may release updates to:

• fix bugs
• improve performance
• improve accessibility
• introduce or improve features
• maintain compatibility with operating systems and devices
• improve security
• update learning material
• reflect changes to the theory test or relevant rules

You may need to install an update to continue using certain features.

We may change, replace or remove features where reasonably necessary to maintain or improve the product.

Where a change materially affects something you have purchased, your statutory consumer rights remain unaffected.

16. Availability

We aim to keep Driving Theory Test Kit available and working reliably.

However, we cannot promise that every online feature will be available without interruption at all times.

The service may occasionally be unavailable because of:

• maintenance
• updates
• technical faults
• internet or hosting failures
• third-party service outages
• security issues
• circumstances outside our reasonable control

Where reasonably possible, we will work to restore affected services.

17. Devices and compatibility

You are responsible for using a device and operating-system version that meets the compatibility requirements stated on the relevant app-store listing.

We cannot guarantee continued compatibility with every device or operating-system version indefinitely.

Where compatibility requirements materially change, we will aim to communicate this appropriately.

18. Intellectual property

Driving Theory Test Kit and its original software, design, branding, interface, graphics, written material and other original content are protected by intellectual-property laws.

Some material within the app may belong to third parties and be used under licence or other lawful terms.

Nothing in these terms transfers intellectual-property ownership to you.

Your purchase gives you permission to use the product in accordance with these terms; it does not give you ownership of its content or intellectual property.

19. Acceptable use

You must not use Driving Theory Test Kit:

• unlawfully
• fraudulently
• to interfere with the service
• to introduce malicious software
• to attempt unauthorised access
• to obtain other users' information
• to circumvent security or content protections
• to systematically copy or extract protected content
• in a way that infringes our rights or the rights of another person

We may take reasonable steps to protect the service where we detect misuse, abuse, security threats or infringement.

20. Suspending or closing accounts

We may suspend or restrict an account where we reasonably believe this is necessary because of:

• a serious or repeated breach of these terms
• fraudulent use
• misuse of the service
• attempts to compromise security
• unauthorised extraction or redistribution of protected content
• legal requirements

Where appropriate and reasonably possible, we will explain the reason.

Nothing in this section affects your statutory rights relating to content you have purchased.

21. Closing your account

If account functionality allows it, you may close your account using the available account controls or by contacting us.

For information about what happens to personal information when an account is closed, please see our Privacy notice.

Deleting an account does not necessarily cancel or reverse an app-store purchase.

22. Third-party services

Driving Theory Test Kit may rely on third-party services to provide parts of its functionality, including app distribution, hosting, authentication, communications and other technical infrastructure.

Those services may have their own terms and privacy policies.

Where you use Apple App Store or Google Play services, your relationship with the relevant store is also governed by its applicable terms.

23. External links

The app or website may occasionally contain links to third-party websites or resources.

We are not responsible for third-party websites or their content, availability or privacy practices.

A link does not necessarily mean that we endorse the third party.

24. Our responsibility to you

We do not exclude or limit liability where doing so would be unlawful.

Nothing in these terms excludes or restricts your statutory consumer rights.

We are responsible for losses that are a foreseeable result of our breach of these terms or our failure to use reasonable care and skill where applicable.

We are not responsible for losses that were not reasonably foreseeable when you entered into the agreement with us.

Driving Theory Test Kit is supplied for personal and non-commercial use. We are therefore not responsible for business losses arising from your use of the app, such as loss of profit, revenue, business or business opportunity, to the extent permitted by law.

Nothing in these terms limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot legally be limited or excluded.

25. No guarantee of test results

We cannot guarantee that using Driving Theory Test Kit will result in you passing the official theory test.

Your result depends on your own knowledge, preparation and performance, as well as the questions and situations you encounter during the official test.

Scores, progress measures, mastery indicators, readiness measures, recommendations and mock results within the app are intended to support your preparation.

They are not guarantees or promises of a particular test outcome.

26. Privacy

Our Privacy notice explains how we collect and use personal information associated with Driving Theory Test Kit.

Please read it alongside these terms.

27. Changes to these terms

We may update these terms from time to time, for example where:

• the product changes
• the law changes
• app-store requirements change
• our services or technology change
• we need to improve clarity

The current version will be available at:

The date at the top of this page shows when these terms were last updated.

If a change materially affects existing users, we will take reasonable steps to bring it to their attention where appropriate.

Changes will not remove statutory rights that already apply to your purchase.

28. Governing law

If you are a consumer living in the United Kingdom, these terms are governed by the applicable laws of the part of the UK in which you live.

You may bring legal proceedings in the courts available to you under applicable consumer law.

Nothing in these terms deprives you of mandatory consumer protections that apply to you.
